On Wednesday, Florida’s 1st District Court of Appeal ruled that the 1987 statewide open-carry ban on firearms is no longer constitutionally enforceable, requiring gun laws to be rooted in historical tradition.
The case stemmed from the July 4, 2022, arrest of a man in downtown Pensacola carrying a visible, holstered pistol and a copy of the U.S. Constitution. The three-judge panel in Escambia County vacated the man’s sentence.
Several elected officials from Parkland—the site of the state’s deadliest school shooting—criticized the decision as dangerous. Restrictions on carrying firearms in sensitive locations, such as schools and courthouses, will remain in effect.
State Leaders Grieve Charlie Kirk
Charlie Kirk, a part-time Florida resident, political commentator, and founder of Turning Point USA, was shot and killed on Wednesday during an event at Utah Valley University. Kirk’s death prompted an outpouring of grief from Florida leaders.
Gov. Ron DeSantis called Kirk a “warrior for liberty” whose murder is a “tragedy for our nation.” Rep. Byron Donalds remembered his friend as an “American political legend” who “fought to make our country a better place.”
Sen. Rick Scott said he was “completely heartbroken by the tragic loss of my friend,” adding that Kirk “started an incredible movement in our nation.” Rep. Anna Paulina Luna, who had worked for Kirk, posted, “I would not be here if Charlie Kirk had not gotten me involved.”
Kirk was in Utah for his “American Comeback Tour,” which brought thousands to Florida State’s Landis Green in Tallahassee on Feb. 28. Kirk lived in Arizona and had a vacation home on the Gulf Coast in Southwest Florida.
Florida Top State for Education Freedom
Florida is number one in education freedom for the fourth consecutive year, according to an annual study by the Heritage Foundation. Florida’s universal school choice program and parental rights in education laws were cited as the reasons.
The Education Freedom Report Card began in 2022, and Florida has earned the top ranking every year since. The report ranks states using five categories: school choice, transparency, regulatory freedom, civic education, and spending.
